Rule text
All applicable affirmative defenses shall be pleaded in the answer under the heading ''New Matter.'' A party may set forth as new matter any other material facts that are not merely denials of the averments of the preceding pleading.
Note: Rule 3.11 has no counterpart in former Orphans' Court Rules, but is derived from Pa.R.C.P. No. 1030. The filings required by this rule are subject to the Case Records Public Access Policy of the Unified Judicial System of Pennsylvania. See Rule 1.99.
