Rule text

a. If the Committee determines after a formal hearing that the charges against the judge have been proved by clear and convincing evidence and that a recommendation should be made to the Supreme Court for public admonition, reprimand, censure, suspension, or removal, it shall promptly file with the Clerk of the Supreme Court a Presentment setting forth its findings and its recommendation.

b. If the Committee determines after a formal hearing that the charges against the judge have not been proved by clear and convincing evidence or that the conduct does not warrant a recommendation for public admonition, reprimand, censure, suspension, or removal by the Supreme Court, it shall promptly file with the Clerk of the Supreme Court a Report setting forth its findings and recommending the dismissal of the complaint with or without private discipline, and the Committee or the judge may request the Supreme Court to issue a short statement announcing its disposition.
